Telemarketing and Job Losses
Telemarketing and DO NOT CALL lists sure made headlines, but I bet there is something you did not realize. The good news about such industries is they bring in good telecommunication infrastructures, lower costs for consumers telephone bills, and are pollution free. Many smaller cities in the country, places like Lewiston, ID worked really hard to bring in such businesses to help pay for fiber optic lines and change the needs of the area and their dependence on polluting factories. Above ground coal mines such as in Gillette, WY have a ten-fold advantage. The areas in WV were call centers are have brought economic prosperity to down ridden areas which have suffered so many industry job losses. Luckily for his company so far the FTC telemarketing lists for Do Not Call, have discouraged the less professional companies and will probably help their company as they have contracts with fortune 500 for inbound telemarketing as well as political campaigns which of course you knew would be exemt. But here again is an issue of not understanding what you are doing when you make a law. A professional telemarketing company does not call at dinner-time. The unprofessional ones are now going to be gone, but further legislation is on its way and that might effect their company and several other clean industry call centers in many parts of semi-rural America where manufacturing jobs have gone by the waste-side. Accounting Nightmare at the FTC Most government agencies cannot pass an audit of their expenses. I can vouch for that and have been a long-time advocate; that the government follow the same rules they force on business. Walk the Walk; In 1990 Bush Sr. signed The Chief Financial Officer's Act. The Act called for 14 cabinet level departments and 10 major agencies to appoint CFOs and try to emulate business and accounting standards used in publicly held corporations. The act and other financial reform legislation that followed, required that 24 agencies produce auditable Financial Statements. Guess what? The Will To Fight for Islam The more I study the dynamics of WWII the more I am convinced that we won the war because of our entrepreneurs and their output; manufacturing capability. With most other things being equaled; technology, techniques of war strategy, etc.; only two things won us the war. The Will to Win, and the never before achieved industrial output. I can safely say in the car wash industry no one has more will than us and no one has the ramp up capability that could supercede us. Does this mean the US will for ever completely dominate the industry? No, nothing is set in stone and there are many possible futures and outcomes. However, with all things being equal and our teams ability to adapt and roll with the punches I believe we have the best odds of victory. Each time we bring more fervor, more resolve and more will to the table we just that much closer to being the top dog. Size does matter, but size alone does not proclaim advanced victory. I think the movie Rocky said it best. He was in it heart, body and soul to win it. Everyone could identify with that movie and wanted Rocky to win, but no one more than Rocky himself. This technology exists now and has been tested, the technology is not so difficult or complicated, and it is relatively simple and easy to understand. Jobs and the Flow of Fuel We see today a fierce unspoken competition between trucks and trains. It is well known in those industries and with those who ship the products, components, parts, natural resources, produce and event he fuel itself. After all the fuel competes for the cheapest mode of delivery as well. Whether it is a pipeline, rail car, tanker truck, ship, barge, etc. In the case of military, you can add in all the squadrons of flying gas stations too. The price of fuel can be the savior to an industry which is hammered by over seas competition or is trying to find a little more room to cut costs to appease a persnickety union with greater health care costs, safer working conditions (at least they often claim that), less working hours, more paid vacation time, bonuses, higher pay, etc. The money has to come from somewhere and the price of fuel and the supply will often determine the viability of a large corporation. Those companies, which use lots of fuel are very much affected by these trends. For instance; Airlines, Trucking Companies, Railroads, Manufacturing Companies, and Service Companies of every shape and size. When these companies pay more for fuel those prices are figured into the price to the customer. When such companies have long term contracts to a customer and the price moves upward to quickly then these companies have to eat that cost. This causes huge operational losses and poor quarterly earnings, which effects their market valuations due to hammering by the gambling casino stock markets when they report these losses. This in turn leads to massive lay offs. Which is not a good thing. China Finds Humans to Test Bird Flu Vaccine On, in Qinghai China is serious about breaking into the bio-tech field and has a vaccine to stop H5N1 Bird Flu strain. Recently they admitted over 160 people died and today they now admit it was actually 460 people. 13,000 birds have been incinerated and this is only in the Western Province of Qinghai; there is also an outbreak in Southern China too. Federal Trade Commission Franchising Division; Inept? Why are we over regulating the franchising industry? What are we doing to an industry which has given so much to America? Is the Federal Trade Commission Franchising Division; inept? They keep making rules and the over disclosure has the average UFOC ? Uniform Franchise Offering Circular at over 200 pages? This is insanity; not to mention a waste of paper. Alternative to Land Mines in Middle East With the recent threats from Bin Laden and Al Queda to attack Oil Fields, Pipelines, Facilities, Refiners and Assets of Oil Companies which supply the United States with it's need fuel, such operations will have to upgrade and defend themselves. There are many options from robotics to land mines. Yet many options involve killing trespassers indiscriminately with robotic sentinels: PTO - Patent and Trademark Office needs complete overhaul Recently in Maine, I talked with a gentleman and we discussed at a coffee shop the issues concerning the Patent and Trademark Offices and the slow processing problems with registration of everything from a simple patent or concept patent to a Registered Trademark or Service Mark. Also this past week had an email conversation with a gentleman from NC in a small business regarding weak trademark and service mark case law in several states and at the Federal Level and how that affected him and the owner of a mark in Ohio. Also discussed the issues with an Aussie who now lives in BC Canada with regards to a cross border US Competitor using a name he intends to use and has already used in Canadian Commerce. First use laws and case laws are different that in Canada and the US. And certainly no trademark is worth a dollar in China. Some would disagree if you have the right attorney there in that country. I had mentioned these types of issues in a letter to the FTC and discussed the problems with patent law and not knowing, the patent books, which explain all this are over 400 plus pages now and when you are done reading them you may or may not know enough to get the job done. Maryland State Legislator wants to kill jobs and small business Last year a Maryland State Legislator whom I presume never owned a small business of any type suggested that franchises in the state needed to be audited every year. This would be every fast food restaurant, small business service van franchise or dog groomer in the state, which was a franchised outlet. The average cost of such audits in Maryland due to all the Maryland lawyers suing is about $40,000. Now obviously this would kill small businesses in the state and cause the raising of prices to all consumers who bought a burger, got a hair cut or had their dogs groomed and the small businesses would have to pass the costs on. We were able to get that asinine proposed bill killed in committee. What kind of a moron could come up with a bill? Well believe it or not such bills pop up all time around our country. One such bill is the Sarbaines Oxley bill, yep came from another Merry Lander Senator Sarbaines who probably sees his ignorant mistake and is NOT running for re-election. Here is the letter we rifled to every legislator in that state, to hell with these folks who propose such potentially damaging blows to our small business community. Some of the data in the research did not predict what would happen, probably because research people are not; go for it, make it happen entrepreneurs. So their report was just 1000s of pages of incessant data about nothing and basically BS. It was much like a master thesis of a psychology, philosophy or work of a business student at any university. Mental Masturbation of FTC Franchise Rule Report Please read through this quick thought and discussion as if a conversation where one party has been taken out and we are left with a monologue as the other debater is missing. Assume that debater is the compilation of arguments presented and only existing in the 432 page, 10-year late report of the Federal Trade Commission' Franchise Rule, for it does not exist in reality or in any way lend itself to any sort of modern day economic theory of free markets, free men, the rights of men and created corporate entities to free contract. Bringing Back Mining Jobs to the United States With new environmental technologies and modern efficiency methods in mining can we revive this sector of our economy. It would be great for manufacturing costs and coupled with the current low dollar we stand to make gain quite a bit if we can. By doing this the job of doing mining correctly it is feasible, but environmental laws are not the only regulations that mining operations have to deal with, once you let those bastard regulators on the property they are only interested in finding something wrong to pay for their trip. Fire Fighting and Healthy Forests There is debate about the methodology of forestry and also debate on Global Warming and the disappearance of our natural resources on the surface, namely forests and Rain Forests. Last year the Alaska Fire burned over 280,000 acres in the very first day and it continued to grow as all big fires do. Obviously the Spruce Forest is an important natural resource. An ongoing debate is do we tackle these fires or let them burn themselves out clearing the younger trees and underbrush build up? Luckily in this case we got some help from Mother Nature to save some of the spruce forest there, yes you guessed it; Rain! Trade Wars, China and Over Regulation At Home We are seeing some trade wars brewing as American trade deficits mount and the money flows moving to China. We see OPEC manipulating our supply a tad and China's thirst for oil increasing, thus furthering the supply issues. We must keep our trading partners and play on a balanced field to keep peace in the world. When playing fields are tiled feathers get ruffled and history shows the unfortunate possibilities that can ensue. Rugged Individualism vs Human Nature "Rugged individualism" is actually a euphemism for Thomas Hobbes' baseless concept of man's natural condition as a war of everyone against everyone else. Even different species of wild animals (each of which has its own group soul, as opposed to humans, which have individual souls) cooperate with one another for their mutual benefit, so Hobbes would have had us believe that mankind is inherently more bestial than the beasts, perhaps explaining the name of the pop "music" group known as the Beastie Boys.
