Employment Legislation: Proposed Employment Law Changes - To Take Effect 1 October 2005
Proposed changes to the Sex Discrimination Act ("SDA") 1975 and the Equal Pay Act ("EPA") 1970 under the amended Equal Treatment Directive (2002/73/EC) will be implemented on 1 October 2005. The proposed changes to the law will be applicable to all employers and providers of vocational training: As of 1 October 2005, there will be a new definition of indirect sex discrimination in employment matters and vocational training. Indirect sex discrimination will occur when an apparently neutral provision, criterion or practice that applies to all workers or applicants causes particular disadvantage to certain sections of women or men. To avoid or succeed against a complaint of indirect sex discrimination, an employer will have to justify that a provision, criterion, practice or policy that it employs, and which causes such disadvantage, meets a business aim and is an appropriate means of meeting this aim. For the first time, there will be a cause of action under the SDA for harassment on the grounds of the complainant's sex. The new provision will apply to the areas of employment and vocational training only. New explicit provisions will be included to ensure that women are protected from discrimination on the grounds of pregnancy. The geographical coverage in the SDA and EPA have been extended, so they now cover employees who work for British organisations outside Great Britain (GB) in relation to recruitment, terms and conditions, pay, promotion, transfers and dismissals. An employer will have the right to refuse to offer a particular job to someone who was intending to undergo, was undergoing or had undergone gender reassignment. However, such a refusal must now be reasonable. The SDA protection will be extended to cover vocational guidance and unpaid practical work experience. The SDA will be amended to prescribe an eight-week time limit for the employer or training organisation, for example, to return the questionnaire in cases of discrimination or harassment in employment and vocational training. The proposed changes to the law applicable to certain employers, certain providers of vocational training and those who appoint office holders: An exception in the SDA, which permitted partnerships and trade unions to discriminate on grounds of sex in the provision of death and retirement benefits to their partners and members respectively, will be removed. There will now be further protection against discrimination for office holders. There have been countless ridiculous failures at identifying the trends and products which will determine the future shape of our life and our environment. Even more difficult is trying to guess which of us will be deemed a useful member of the community ? and which an obsolete relic. To a large extent, the answer to this question lies in determining the useful professions of the future. This is an age when people are determined, defined and categorized in strict accordance with their professions. Whereas during the Renaissance, a person might have been defined by his range of interests (remember the likes of Leonardo da Vinci), by his familial, religious, or ethnic affiliations, by his or her gender and so on ? today the first and foremost question is a person's profession. The first question that we must provide a clear answer to is: What constitutes a profession (as opposed to a hobby), a vocation (as opposed to an avocation)? To qualify as a profession, the act must bear the following hallmarks: PA Congressional Pay Hike Raises Eyebrows While many Pennsylvanians are struggling to figure out how they can pay their real estate taxes before the end-of-the-year deadline, the PA congress not only votes an extra $11,403 onto their base pay, but those on committee chairs receive an additional $4,050. Speaking in terms of percentage, the pay hikes ranged from 16% - 34%, while most of their constituents are lucky to see a 3% raise. At least the past congressional bodies, in their wisdom, made a congressman's pay increase not take affect until the following election term. Our entire federal tax contribution to our government is 829 Billion. Think of it this way every cost to a business is passed on to the consumers and in some respects that is a tax as well. It means you pay extra for nearly everything. Did you know the entire GNP of Canada is only 595 Billion total. Think of this, every time our company sells a franchise or our franchisees wash a car a large part of that price is due to over government regulation. If 788 Billion is the total cost of regulations and many of the things that are required may actually be approved by the public and only half of the regulations are legitimate to "Protect the People" our governments ONLY real job, then 394 Billion dollars is passed onto the consumer as a HIDDEN TAX. Of course there are many names for these taxes we pass on to our consumers and not by desire. Does Your Farm Stink? Justice Department Losing the War on Street Gangs The Justice Department is at it again; promoting themselves in the mass media attempting to convince us we are safe. This time they are grandstanding a few arrests of alleged gang members. MS-13 is recruiting over 300 people per week in cities across the United States. Recently the Justice Department held a huge press conference, claiming that in a two-week period they arrested 582 people. Now then if the MS-13 gang is recruiting 300 people per week and the caught 582 in two-weeks then they are 18 gang members in the rear for that two-week period alone. Most of the offenders, gang members were said to be picked up between July 16 and July 28, other arrests followed after search and seizures of evidence was taken. Do not get me wrong it is great to catch these drug sellers, thieves and felons, but at a growth rate of 300 per week and an estimated 10,000 members and growing MS-13 is hardly under control; it more resembles a wildfire nearing its maturity. Garbage in Garbage out; California Blackouts Why did the California energy crisis happen? Who is to blame? How come deregulation was a financial disaster?
