Lawyers and Franchising
It is amazing how the Federal Trade Commission has destroyed franchising, by selling the industry out to lawyers. We need to have accountability for the regulators and we can start by firing the head of the Franchising Group at the Federal Trade Commission and anyone who has worked in that department in the last 6-10 years. Let me give you an example of what the Federal Trade Commission's Franchising Group's policies have made a mockery out of the purest of business models; Franchising. A Judge ruled that the Krispy Kreme franchisor partly contributed to the underperforming franchisees. Many of which are close to bankruptcy, of course it wasn't the diet craze of South Beach or Atkins, no, it was the franchisors fault? But the franchisor had problems as it expanded to fast and the market changed, which is a normal business risk? Without risk there is no free enterprise. The judge further ordered the franchisor to continue to ship product to the franchisees, even when the franchisee was not able to pay for the goods? What kind of crap is this? It gets worse, but how can this be? Well check this out: The lawyers representing the franchisee are cousins of the lawyers representing the franchisees. Interesting? Indeed. Now, then how do you suppose that happened? "Hey, cous; I have a plan. You see we. . . whisper, whisper, whisper and then we both make money and who cares who wins the suit, we make lots of money in fees?" Isn't it sickening the lawyers are ruining franchising in this way? Why is this happening? It is happening due to the incompetence of the Federal Trade Commission in my opinion. As one man turns over an industry to lawyers, an industry that accounts for one-third of every consumer dollar spent in our nation and represents 450,000 outlets and an estimate 15 million jobs? It is a law that if you are a black belt in a Martial Art, that you must register your hands as a deadly weapon in many states. These registered names should be on the Internet for all to see in the local area incase they attempt to pick someone up at a bar and so that if someone is to use the online dating methods, the other party can check to see if their potential homosexual date has the virus ahead of any meeting. NASCAR to be Shut Down by FTC? The Federal Trade Commission has very important Anti-trust Laws. They say these laws protect us from Evil Monopolies. Many believe this is in the best interest of our civilization, society and of course the consumer. The NASCAR franchise is absolutely a monopoly and successful because people love NASCAR. It provides the fans what they want and we gladly pay to watch the most competitive men and machines trust thru the laws of physics to greater and greater speeds and efficiency. She teaches people how to lobby? Good heavens, she's not a lobbyist herself, is she?" Apparently, being a lobbyist is right up there with being a convict, especially these days. The end of geographical isolation will be a new beginning for hundreds of thousands of people in Afghanistan. Globalization Often we see protests at the sites of global leader gatherings. Some complain Globalization is bad, that a one world currency is evil and that there is a huge conspiracy a foot to control all of mankind. Yet, these same folks often fail to see the incredible advantages to trade and quality of life that a one-world scenario can provide. They fail to understand the issues of free trade and what we can do for the third world. Before you buy into the anti one world theme and do your family name the dishonor of standing on a corner and making a fool of yourself, there is a book I recommend that you read: The History of Trade and Using it as a Weapon for Peace The Flow of Trade is a major consideration of civilizations and cultures working together to insure that they can get what they need. Some areas have special crops, which grow in their regions, which the other regions would like to have. In days of the First colonies in this country, before it was a country trade with the local Indians were vital to them staying alive. Is the auto industry, which is the state's manufacturing rock really in jeopardy. Are the Unions really killing the manufacturing sector causing off shoring of American jobs? Let me offer an alternative view of the situation from an Ayn Rand perspective. Yes the manufacturing sector took hits from steel prices, unions, power costs, sector rotations in the auto industry as well as over seas and NAFTA competition. But the biggest problem of all is none of those things. Not a single one could kill off an industry that sells on average of 15-18 million cars per year. One must look at other factors as well. Also out in full force is our wonderful OSHA Agency due to strong union and the online complaint system. Open Source and Post-Capitalistic Society Capitalism as the social structure was founded in order to support further evolution and development of human race, to support the innovation which was oppressed by the former system. It was brought up by the two industrial revolutions. The technology was obviously the main to blame for the outcoming capitalistic society. The new capitalism was more liberalistic promoting free trade and pushing globalization in order to support further development and growth of technology. Take Marijuana Off the DEAs Docket Quit paying the DEA to chase marijuana. We could save millions for education (or tax credits, for you republicans). We spend millions locking up Americans for using marijuana. Or as NORML says in a 1999 billboard campaign up in bus shelters around the city, "A Pot Smoker is Busted Every 45 Seconds -- and You Wonder Why We're Paranoid." UK Elections on the Horizon With elections on the horizon and Blair looking tired and increasingly defensive, just what is likely outcome of the next election? The New Labour adoption of Tory plans and policies has created an almost parallel party in terms of the Conservatives and Labour. Many people are confused and find it hard to tell them apart. The Labour Party will struggle to retain the loyalties of the staunch labour support it has enjoyed over the decades. Governments Worst Agency Everyone knows the United States Government often falls down in their duties. Although over all the country is great and for the most part seems to work, there are several agencies that get an "F" on their report cards from some who act as government watchdogs. In my opinion there is no bigger waste of taxpayer's money than that of the Federal Trade Commission. Having studied a few cases it appears obvious that this worthless agency cannot seem to do anything right. The sooner we close this agency or reduce its budget the better. All money spent in the agency is completely wasted. They cannot get rid of SPAM, it is up over 3000% since they started working on it. Identity theft issues in our country have run ramped and the FTC need to answer some of those Viagra SPAM adds as they are utterly impotent in their enforcement of this as well. What Is The Filibuster All About? The filibuster has been a tool available to U.S. Senators during Senate floor discussions on legislation and appointments since the U.S. Constitution was ratified. Both the Democratic and Republican parties have valued the filibuster as a means to bring compromise and bipartisanship to bitter and divisive debates. Anglo-Israelism and the Flesh Recently a friend insisted that I read a book by Steven M.Collins, titled The "Lost" Ten Tribes of Israel...Found! This book tries to convince people that the "Lost" tribes of Israel after being uprooted by the Assyrians, started colonies all over the world and then ultimately migrated to Britain and then to America. The book attempts to prove in 439 pages what has been known as British- or Anglo-Israelism. The book was originally written in 1992 and was revised in 1995 and is gaining influence in some "patriot" circles. Some people who hold this theory are racists, following from their fleshly or carnal understanding of the outworking of God's covenant in history exclusively along racial lines. A major thesis of the book is that the Jews (Judah) and Israelites are two separate and distinct peoples and kingdoms who must never be confused. Mr. Collins says, "...the Jews ceased to be part of the kingdom named Israel" (23). The author goes on to say that "the term 'Israel' does not apply to Jews from the time of the divided kingdom forward" (23). Is this true? This is not a comprehensive review of Collins' book. There are numerous problems in this book, some of which are dealt with below. |
