Congress Considers National Data Privacy Law
Legislation was introduced into Congress this week that would establish a national data privacy law. The bill would require businesses to disclose to consumers any breaches that result in the exposure of personal information. The legislation is a reaction to the massive security breaches that have occurred over the last year. In the most notable breach, over 40 million credit card numbers were exposed in a security breach involving CardSystems, an online processor. LexisNexis, Bank of America and other corporate entities have also suffered breaches exposing the personal information of millions of individuals. Under the new legislation, businesses exposing the personal information of more than 1,000 individuals would be required to notify the individuals. Failure to comply with the law would result in penalties of up to $11 million per incident. Interestingly, the legislation would bar businesses and schools from putting Social Security numbers on any form of identification. Upon receiving notice, consumers would be allowed to put a notice on their credit reports, which would prevent any company from providing new credit under their name. This would effectively stop thieves from opening new credit accounts with the stolen information. Will It Pass? The new legislation has a very good chance of becoming federal law. Sponsored by two Republicans and two Democrats, the bill appears to have bipartisan support. Avoiding the vicious partisan politics on Capital Hill is half the battle for any legislation. Corporate America also appears to be getting behind the bill. Although this might seem surprising at first, there is a good reason. States including California, Washington and Georgia have already enacted similar laws, but each requires different actions. A federal law, however, will trump all of the state laws and create a uniform requirement for businesses. From a practical standpoint, Corporate America would prefer one standard instead of many. The new bipartisan legislation is a welcome step in the effort to fight identity theft. Many more steps, however, will be required. You should continue to closely review your credit card statements and credit reports for any unauthorized charges. After all if you are right wing conservative Christian the last place you would want to send your heterosexual kids to is an Army filled with gays. The Route to Democracy Fifteen hours is a tremendous barrier. It is the obstacle preventing one village from attaining the assistance of another and surviving a drought. It is the reason a trip to the hospital, or receiving an education, aren't realistic options. Fifteen hours is what stands in the way of commerce between two provinces. It prevents communication between neighbors only 80 kilometers apart. Fifteen hours is the reason for isolation. Before Task Force Pacemaker began work, the drive between Kandahar and Tarin-Kowt took fifteen hours. Upon completion of the road it will take only three. In our attempt to move the human race into a different space we are also changing the theory of war in order to do so. Yet at the same time not admitting that we are not so good at it, as we are led to believe by the academics. FTC Franchise Rule Making Sound and Fury in the Sand Box of Free Markets Today we have a new franchise report from the Federal Trade Commission to further inhibit the franchise model thru more redundant paper work and over regulation, which will only serve the lawyers and give job security to the bureaucrats. However, it serves no free man in this present period. If you look at all the comments in the FTC's franchise report and rule making session; you see dickering from both sides over phrases, disclosure topics, wording in the UFOCs from lawyers, franchise rights groups and industry associations. No Child Left Behind needs to go Virtual The No Child Left Behind can work if the Federal Government will put up content on the website and allow for those who are; Behind in studies, about to miss a grade level advancement, perform poorly on general tests, at home schooling students (when parents have no knowledge in subject matter), are in Juvenile Hall, live in areas very rural, have disorders, or have injuries which prevent attendance or need Summer School catch up work. Let us Disband The FTC?s Franchising Division Previously Senator Dick Armey and his staff in 2000 to review seriously the important decision to scrutinize the FTC's franchising division. Mr. Armey has sense retired. Today, I urge the Administration, the GAO, Senate Subcommittee and other governmental oversight bodies to curtail the efforts of the FTC to further over regulate the MUD (much unnecessary disclosure) plaguing our industry. How much should the FTC's franchise group be downsized? We see by the introduction of a proposed change and additions to the franchise rule that they have over stepped their usefulness in franchising, so perhaps that division should receive no funding and be immediately disbanded. I have an interesting case study and 2000 pages of proof of innocence of an action taken against my company by the FTC. Yet he failed to mention the real problem, the lawyers, over regulation and government bureaucracy. They seem to be under the impression that Americans did not want to work in manufacturing jobs? What on Earth was he thinking? If the CATO Institute, a conservative free enterprise think tank, is going to go on National Television and debate free trade, surely they have more depth to understand the plight of the manufacturers in this country. The book is called: Fuel Prices and Trucking; A Reality Check On What Drives America It appears we are having a terrible situation with the diesel fuel prices in the US. It is affecting everything, since everything we buy is shipped by train or truck and most of the times both. We have artificial fuel price manipulation and large trucking companies operating at less than 3% margins. We have seen 100s of medium size trucking companies file bankruptcy and 1000s of small companies file as well between 1999 and 2002 and we appear to be headed for another round here in 2005. This is causing problems in the used truck sales market. We have noticed this affect with used trucks on this market it is affecting new truck sales right after several major mergers. There have been lay offs at all large trucking company manufacturers. Employees from Volvo, Peterbuilt, Daimler Chrysler who have been laid off, some have hired back a few due to the emissions rules and need for cleaner trucks and also trucks which are more efficient. The efficiency saved at these fuel prices will nearly pay the additional costs of the payments and truck manufacturers intend to capitalize on that fact. When Political Correctness in NOT a Virtue The other day I was sucker punched, hoodwinked, bamboozled, had the wool pulled over my eyes, and generally sidelined by an expert in Political Correctness. In fact, so sidelined did I get that I have been depressed for a week-and I mean really depressed. |
