Investor Banned From Offering Property For Rent
Do you realize that you might be prevented from renting your investment home? Prohibiting property owners from leasing their properties is a trend that is growing increasingly popular with some developers and many Homeowners' Associations (HOA). It's rare that you can buy a new home in a development that does have a HOA. As a homeowner you are bound by the HOA restrictions found in the Covenants, Conditions and Restrictions (CC&Rs). The CC&Rs regulate your use of your property, restricting everything from the color of the house, window coverings, holiday decorations, sports courts, pets, to landscaping and etc. One of the most recent restrictions that builders are including in their CC&Rs is a restriction that prohibits the homeowner from leasing their property. Builders have a provision in their sales contracts stating that the home will be a primary or secondary residence and that the purchaser will occupy the home. The owner is strictly prohibited from renting the home. Why this trend? The idea is to limit the number of rentals in a subdivision because lenders believe that a high number of rentals in a community affects the value of the property and can erode the security of their loans. Existing HOAs like the idea of no rentals and there seems to be a growing movement to amend their CC&Rs to add the "no leasing" provision. Investors Beware! The new homebuyer should be made aware of the no leasing restriction when they buy. But what about the investor who buys a home a few years later? If the investor fails to read and understand the CC&Rs he or she may end up owning a property that they cannot rent. You can't count on the home seller alerting you to the restriction. They may be the third or fourth owner of the home and not even be aware of the restriction. Oh sure, you could buy the home, rent it and hope you are not discovered violating the CC&Rs. However, anyone who has ever dealt with a HOA soon discovers that there are always a few other homeowners with an eagle eye out for the slightest infraction of the CC&Rs. They delight in notifying the HOA management company,,, and the management company is bound to investigate and enforce the rules. For you the investor is no appeal... and there is no recourse. This is a strong reminder that every investor should have a clause in every purchase contract that says the purchase agreement is contingent upon you receiving, reading and approving a copy of the CC&Rs. This is a potential ulcer-creating situation that no investor can afford to ignore. Buying Property in Spain You have made the decision to move to Spain and are now looking for a property to buy? Where do you start?Firstly, I would suggest you go on to the internet and look at the various agents that are offering properties for sale in Spain. Many of these companies are run by people who have already emigrated to Spain and will know the many problems and pitfalls that arise when buying a property in Spain. The next step is decide where you want to live, is it in a Town (urbanization), the Country (campo) even the mountains, the lakes or the Coast. If you want everything close at hand to you, then your best bet would be look at properties in a Town or on the Coast especially if you require medical facilities close at hand. You then need to decide whether you want to buy an apartment, townhouse, villa, finca (country house with land) or a property that needs renovation. You have now made a decision on where you want to live and what sort of property you want to buy. It is now time to start contacting the agents, both those on the internet and those who are located in the town close to where you wish to live. They will not only provide you with the details of properties they feel would be of interest to you, but they should also be able to provide you with details regarding solicitors, banks (if you may need a mortgage to purchase the property), schools, medical facilities in that area. If possible get the bank to confirm with you what sort of percentage of monies they would lend on the purchase of a property, most banks in Spain only provide 75% mortgages. You have now found the property of your dreams, one of the first things that you should ask of your agent is does the owner of the property have the right to sell the property and if so can they produce the papers confirming this. If no such document is available, then ask if they will be drawn up before the sale. If not, then do not proceed with the purchase. Also ask your agent if they can confirm that the property being sold has been provided with all the correct planning permissions by the Local Town Hall. If you find that the property has not been provided with the correct planning permissions by the Town Hall, this may mean that the property has been built illegally. At present the Government in Spain is now starting to enforce the laws regarding illegal builds and this has sometimes resulted in properties being demolished and large fines incurred by the developers. However, the problem above is only a minor one, and as long as you find yourself a reputable agent to help you in your task of finding the property of your dreams then these above problems should be of no consequence to you.I hope that the information provide aboves helps you in make your decision to purchase a property in Spain a pleasant one. Tenants in Common (TIC) Tenants in Common is a way of sharing ownership of property among two or more people. Each tenant holds an undivided interest in the property, and each tenant may own a different size portion of the property. Tenants in common ownership may be established in many different ways: through a will, deed, or other document of title. Today Tenants in Common (TIC) ownership has become a popular way for people to complete 1031 tax deferred exchanges when they hold title as an individual or other entity and would like to participate in a partnership or partnership style structure. Other people are using Tenant in Common structures to purchase multi-family real estate that may be suitable for a condominium (condo) conversion after a certain seasoning period. Dont Sell It Yourself Don't sell it yourself! Sometimes a "FSBO," or house "for sale by owner" can sell as fast, and for as much as it would have if listed with a real estate agent. Sometimes. Before you decide to give it a try though, consider the following ten points. Checklist for Buying a Home I had a client who called saying that his bath tub just fallen through the floor in his new home (new to him). Mold had eaten away the floor from the crawlspace up.
